I received a couple of emails from PicRights in July about a news photo that I used on my website. I thought it would be fair use so I did not even waste time responding. However, yesterday I received a letter with a lot of papers from Higbee & Associates.

I spent more time researching fair use and I was probably wrong to use the image, but my intentions were innocent. I do not want to $1850 for an image that I could have paid $400 for from Getty if I knew I had to. Are there any other defenses I could have or ways of not paying so much?? Help!

If you are going to raise defenses other than you have a license, you probably should get an attorney or just negotiate for a lesser amount.
